Thank you for visiting our website or our workshop we have tried to make it a pleasant journey.

With our website once you have opened the site and chose to browse around we consider these actions to show that you have agreed to our terms and conditions.

We have put thought into these Terms and Conditions to include statutory rights and also to protect you as a buyer and us as sellers. We are a small company and are always available to talk about any problems.

The terms and conditions shall be governed by and construed in accordance with the laws of England

• Kernow Fleece is not a limited company. Kernow Fleece.com is the website of Kernow Fleece which has a physical workshop and retail space at Unit 3, Lower Wharf, Bude, EX23 8LG.
• Your contract to buy goods, created in accordance with these terms and conditions, is with Kernow Fleece the trading Nicola Rufus.
• In addition to these terms and conditions your purchase is governed by our Privacy Policy and our cookie policy.
• If you are under 18 years of age and using our website please inform a parent or guardian and let them know about our Privacy Policy.
• The ordering process

We design and make all our clothes in our Bude workshop. We hope you love the designs and enjoy wearing them.

When you place an order we begin the process of entering in a contract whereby you chose the item and pay and we provide the item.

1. Our website is what is known as an invitation to treat, a showcase of what you may like to buy.
2. When you make an order you are making an offer
3. The money you pay is the consideration for our contract
4. all orders placed are subject to acceptance by us and product availability

‘Cooling Off’

• Once you have clicked the “confirm” button we check our stock if we have the item made we will send it out as soon as practicable, if we do not have the item in stock we make the item to your order. This is why we say that delivery can be two-three weeks. If you need an item by a particular date please let us know.
• Prices and delivery charges are shown on the website and are in British pounds and inclusive of VAT. If you are shopping from outside of the UK additional costs will apply.  We do not offer VAT refunds on orders delivered to the Channel Islands.
• Once you have placed your order you will receive an email acknowledging the details of your intended purchase.  This email is NOT an acceptance of your order. Unless you cancel your order ACCEPTANCE and completion of the contract takes place when we dispatch the goods to you.
• We reserve the right in our sole discretion not to accept your order, process your transaction or refuse to provide a service to you. We will not be held liable to you or any third party for withdrawing our stock from our website, refusing to process a transaction or unwinding or suspending a transaction after the processing has begun.

Payment

• Payment can be made by Visa, Visa Electron, MasterCard, Delta and Maestro debit cards and PayPal. Payment by card will be debited and cleared from your account upon receipt of your order by us.
• All debit and credit card payments are subject to validation and authorisation by the relevant card issuer. If for any reason the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery to you.
• We take all reasonable care to make every part of the ordering payment and delivery secure. We will not be liable for any loss you may suffer should a third party obtain unauthorised access to any of your personal data on our site unless we have been shown to be unreasonably negligent. 

• In law the Distance Selling Regulations give you a right to a “cooling off” period of 14 days in which to cancel the contract if you don’t want the goods that you have ordered for any reason at all.
• If you wish to change your mind and return the items let us know by call 07474256874 or email info@kernowfleece.com and please return the goods in a saleable undamaged condition.
• We are not liable for the cost to return the goods.
• We must receive the goods 14 days from when you tell us that you no longer wish to have the goods.
• Once we have received the goods and verified the condition we will refund the purchase price by the method you purchased the item.
• We reserve the right to make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.  

Returns Procedure

We are happy to accept returns if you are not happy and will refund or exchange.

You will need to use suitable packaging and within 14 days post the goods back to us at:

• Include proof of purchase and it would be great if you could give your reason. If you think it’s an awful colour its really useful to us to know!
• Once we receive the goods we will check to see if they have been worn or mishandled if they are of saleable condition we will exchange or refund via the method you purchased them.
• We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.  
• Your statutory rights are not affected.

E-receipts

• All our UK customers are now able to get receipts as an email when they shop in our stores. Many customers like to keep the receipt electronically so it’s easier to find in case for example they ever need to return or exchange a purchase. When you make a payment by card in our workshop you will be offered an option for an e-receipt. If you choose to opt-in to e-receipts then you will be sent an email with your e-receipt and will be added to our mailing list. If you do not want to receive our offers and promotions by email you can unsubscribe by unsubscribe by emailing into info@kernowfleece.com

Postage

• If you have changed your mind we ask for you to pay for the postage but if it’s our fault we will reimburse you to a £3.50 maximum.
• Please keep your proof of postage.

Mailing List 

• To keep you up to date with our latest products, news, promotional offers and events we will contact you by email or post. If you do not want to receive our offers and promotions by email or post, you can unsubscribe by emailing into info@kernowfleecebude.com
• Service emails (e.g. order confirmation) are separate to the mailing list and will continue if you unsubscribe to the mailing list. 

Privacy and Cookies

• All Personal Information is treated as confidential.  We will only disclose this information as required by law. We will keep your Personal Information on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation from time to time in place.
• When you come into our workshop and on our website you will be offered to join our emailing list shop for which we will collect personal Information from you such as your name, address, e-mail address, telephone number, product selections, credit card or other payment information.
• Our third party providers of content may collect information about where you are on the internet, your browser type, the country and telephone area code where your computer is located , the pages of the website that were viewed during your visit and any search items that you entered on our website (“User Information”).
• We monitor our website and capture this information to improve your shopping experience and to make our service better and to make you aware of exciting offers and promotions.
• To assist with this we may store information about you using cookies which are files sent by us to your computer or other access device which we can access when you visit our site at some point in the future.  The cookies we use enable us to save your bag for later, track the opening of our emails amongst other things.  Our full cookie policy is available on ourwebsite.

Liability

• We do not accept liability (except as set out below) for any errors and/or omissions contained in our website and reserve the right to change information, prices, and descriptions of listed goods at any time with or without notice.
• If an error is discovered we will discuss this on a case by case basis but we are not obliged liable to fulfil the order. We would refund in full any monies paid

• We have tried our very best to provide accurate product images for all of our clothes and accessories. However, a number of factors such as internet browsers, monitor colour and the like can affect the way in which you see the goods. We cannot be held responsible or liable for any difference in colour between the image and actual product.
• We shall have no liability to you for any delay in the delivery of goods to the extent that the delay is due to an event outside of our reasonable control.
• No warranty is given that the website will meet your requirements or will be uninterrupted, timely or error free, that defects will be corrected or that the site or the server that makes its available are free of viruses or bugs or represents the full functionality, accuracy or reliability of the Website.
• We will not be responsible to you for any loss of content or material uploaded or transmitted through the website.
• We will not be liable in contract, tort (including without limitation negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:

any economic losses; or loss of any goodwill; or reputation loss or any special or indirect losses suffered or incurred by that any party arising out of or in connection with the provisions of any matter under these terms and conditions, the provision of clothing or promises to supply of items.

Intellectual Property Rights

• Our designs are unique and created in our workshops by purchasing our products and using our website you are specifically agreeing that all copyright, designs, trademarks and all other intellectual property and material rights in law are preserved and observed by yourself.
• You are not permitted to copy, change, download, adapt, interfere or make use of any contact or design other than for personal use without express permission from Kernow Fleece.

Waiver

• Any waiver by us shall be construed as a waiver of any proceedings or as a succeeding breach of any provision.

Entire Agreement

Please read the entire agreement and accept the Terms and Conditions in the whole in the spirit in which they are intended to protect the buyer and user of the website and to keep the seller s intellectual property safe.

We reserve the right to change the Terms & Conditions from time to time.

Where there is a discrepancy between oral agreements and the Terms and Conditions the written Terms & Conditions take precedent.
